Abstract Criminal law exceptionalism, or so I suggest, has turned into an ideology in German and Continental criminal theory. It rests on interrelated claims about the (ideal real) extraordinary qualities properties of led to exceptional doctrines constitutional prima facie paradoxically perpetuates conserves law, all too often leads ideological thoughtlessness, which may blind us dark sides laws action.
